This process ensures the legal security of documents, confirming that the signature is authentic and not forged.<\/p>\n<p data-start=\"528\" data-end=\"927\">In Portugal, this procedure can only be carried out <strong data-start=\"580\" data-end=\"593\">in person<\/strong>. Therefore, it is <strong data-start=\"612\" data-end=\"732\">not possible to authenticate a signature that was previously placed on a document and sent by email or in PDF format<\/strong>. The main purpose of signature authentication is to formally certify that the signature was made, or acknowledged as genuine, <strong data-start=\"859\" data-end=\"926\">in front of the professional responsible for the authentication<\/strong>.<\/p>\n<p data-start=\"929\" data-end=\"1018\">To complete the signature authentication, the following essential rules must be observed:<\/p>\n<ul data-start=\"1020\" data-end=\"1571\">\n<li data-start=\"1020\" data-end=\"1090\">\n<p data-start=\"1022\" data-end=\"1090\">The <strong data-start=\"1026\" data-end=\"1061\">signatory must appear in person<\/strong> before the notary or lawyer.<\/p>\n<\/li>\n<li data-start=\"1091\" data-end=\"1303\">\n<p data-start=\"1093\" data-end=\"1303\">The signature must be <strong data-start=\"1115\" data-end=\"1161\">placed in the presence of the professional<\/strong>, or, if the document is already signed, the person must <strong data-start=\"1218\" data-end=\"1240\">personally declare<\/strong> that the signature is theirs and accept responsibility for it.<\/p>\n<\/li>\n<li data-start=\"1304\" data-end=\"1571\">\n<p data-start=\"1306\" data-end=\"1571\">The person must present a <strong data-start=\"1332\" data-end=\"1365\">valid identification document<\/strong>, containing both <strong data-start=\"1383\" data-end=\"1411\">photograph and signature<\/strong> (such as a citizen\u2019s card or passport), allowing the notary or lawyer to compare the signature being authenticated with the one on the identification document.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1573\" data-end=\"1695\">The <strong data-start=\"1577\" data-end=\"1597\">notary or lawyer<\/strong> assumes public responsibility when certifying the signature and must follow essential safeguards:<\/p>\n<ul data-start=\"1697\" data-end=\"2019\">\n<li data-start=\"1697\" data-end=\"1774\">\n<p data-start=\"1699\" data-end=\"1774\">Properly verify the signatory\u2019s identity using the identification document.<\/p>\n<\/li>\n<li data-start=\"1775\" data-end=\"1901\">\n<p data-start=\"1777\" data-end=\"1901\">Ensure that the signature placed or acknowledged matches, in appearance, the signature shown on the identification document.<\/p>\n<\/li>\n<li data-start=\"1902\" data-end=\"2019\">\n<p data-start=\"1904\" data-end=\"2019\">Refuse the authentication if there are any doubts about the person\u2019s identity or the authenticity of the signature.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2021\" data-end=\"2292\">This procedure explicitly prevents the authentication of signatures placed on <strong data-start=\"2099\" data-end=\"2136\">documents sent by email or in PDF<\/strong>, since it is impossible to guarantee the authorship of a signature without the signatory\u2019s physical presence and the direct verification of their identity.<\/p>\n<p data-start=\"2294\" data-end=\"2532\" data-is-last-node=\"\" data-is-only-node=\"\">In short, <strong data-start=\"2304\" data-end=\"2332\">signature authentication<\/strong> is a formal act that necessarily requires the signatory\u2019s physical presence and the professional\u2019s direct control over their identity, ensuring authenticity and legal validity of the signed document.<\/p>\n<p data-start=\"2294\" data-end=\"2532\" data-is-last-node=\"\" data-is-only-node=\"\"><a href=\"https:\/\/advocaciapinheiro.com\/en\" target=\"_blank\" rel=\"noopener\">Adriano Martins Pinheiro, lawyer in Portugal<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Signature authentication is a formal procedure through which a notary or lawyer certifies that a given signature was genuinely made or acknowledged by the person identified.
